Terms and Conditions

Excell.Net will invoice accounts as of the 1st day of each month or payment period. Business account invoices will be e-mailed.

No refunds are issued on prepaid accounts.

Payment:

Payments are due on the first of each payment period. Accounts are past due if payment is not received by the 15th of the payment period. Past due accounts will be charge 1.5% per month.  Overdue accounts are subject to suspension. Suspended accounts may be assessed a reinstatement fee. Suspension does not remove the customer’s responsibility to pay fees due through the day of suspension. Customer agrees to pay collection and legal fees incurred by Excell.Net when collecting on delinquent accounts.

PayPal Payments:

Excell.Net will charge a 3.49% surcharge for all payments made via PayPal.

Returned Check Fee:

Excell.Net will charge $25.00 for each returned check.

Cancellation policy:

Cancellation must be made in writing and sent by email to info@Excell.Net (return receipt requested) or US mail to Excell.Net, 470 Mountain Road, Wilbraham, MA 01095 at least 1 month prior to the customer’s next billing date. No refunds are issued on cancelled accounts.

Domain Registrations:

To use Excell.Net’s discounted domain registration pricing, customer agrees to host the domain at Excell.Net. If the domain is moved to another provider prior to the expiration date of the registration or renewal, customer agrees to pay Excell.Net $15 per year left on the domain registration. Upon receipt of payment, Excell.Net will provide the authorization code for the domain to be transferred to another registrar.

Customer agrees to use services and software at their own risk and further acknowledges that Excell.Net and its affiliates shall not be liable to customer or third party for indirect, special, incidental, punitive or consequential damages (including without limitation, lost profits or damages from loss of use of data) arising out of or in connection with any services provided by Excell.Net or its affiliates.

Customer agrees to exempt Excell.Net and its affiliates from all liability relating to any information obtained on the Internet, including the accuracy, quality, offensiveness or sexual explicitness. Excell.Net and its affiliates does not block customer access to any of these materials. Information will be provided, on request, to the customer about actions that may be taken to address this issue.

The performance and construction of all Agreements with Excell.Net shall be governed by the internal laws of the Commonwealth of Massachusetts. Customer agrees that any suit, action or proceeding instituted by or against Customer with respect to this Agreement shall be brought in any court of competent jurisdiction located in Hampden County, Massachusetts. By its execution of this Agreement, Customer hereby irrevocably waives any objection on the ground of venue, the convenience of the forum or the jurisdiction of such courts or from the execution of judgments resulting therefrom. Customer hereby irrevocably accepts and submits to the jurisdiction of the aforesaid courts in any such suit, action or proceeding.

Guaranty: The customer hereby, jointly and severally with Buyer, personally and unconditionally guarantees to Excell.Net (the “Company”) the prompt payment when due of every claim that may hereafter arise in favor of the Company against the Buyer. This is a continuing guaranty and shall remain in force and effect until revoked in writing to the Company. Any such revocation shall be effective only to claims that arise after the receipt of said revocation notice.

Attorney’s Fees: Payment shall be made according to the terms stated on invoice. If the Buyer fails to pay any charges when due and payable, Buyer agrees to pay Company’s costs of collection, including reasonable attorneys’ fees.
